General terms for purchasing FORMED® goods

This section describes the general terms for purchasing goods. The particular product, quantity, configuration, price and performance terms are determined by an agreed order or a separate contract. The buyer’s mandatory statutory rights remain unaffected by the wording on this website.
Enquiries and agreeing an order
The catalogue, selected-products list and enquiry form help prepare a request. Sending such a request does not in itself constitute payment or confirmation that a product is available or that the seller has accepted an order. An automated acknowledgement confirms only that the request has reached the system.
Before a particular purchase is arranged, the parties agree the product name and specifications, quantity, configuration, total cost, payment arrangements, delivery and handover date, as well as the applicable warranty terms. These matters are agreed during subsequent communication with the seller. A contract is concluded once agreement on its essential terms has been reached in the appropriate form. If an individual offer or contract is sent to the buyer, the procedure for accepting it is specified in that document in accordance with legislation.
Payment and delivery
Partial or full advance payment, supply without advance payment, payment on collection or payment on delivery may be agreed for the particular order. Advance payment is credited towards the total price. Payment amounts, settlement deadlines and any fees are communicated before the order is confirmed. Bank transfers are made against an agreed order or invoice; the website does not process online payment for an order through the enquiry form.
Delivery within Ukraine is free on condition of advance payment. Delivery terms without advance payment, the method and timing of handover are agreed separately. Collection is available for an order agreed in advance.
If goods paid for in advance are not handed over within the agreed time, the buyer may request their handover or a refund of the advance payment in accordance with legislation.
Quality, requests and liability
The procedures for exchanges, returns and warranty requests are set out in the separate Product exchange and Product returns sections. Consumer protections apply to purchases by individuals for personal needs; business purchases are governed by the relevant contract and legislation.
The parties are liable for failure to perform or improper performance of their obligations in accordance with legislation and the agreed contract. Requests and complaints can be submitted through the seller’s contact channels. The option of contacting the seller does not restrict the right to other lawful remedies, including court proceedings.
Updating information on the website does not in itself change the terms of a contract already concluded. The processing of user data is described separately in the Privacy policy.
